1.1. What is EB-5? EB-5 immigrant investor program visa

Requirements for basic investment program

1. Investment of US$500,000 or US$1 million (Total investment of US$500,000 to be applied in areas where unemployment rate is 150% higher than the unemployment rate of the nation or where the population is less than 20,000 people).

2. The investment must create 10 full-time jobs for U.S. citizens.

3. The investment must take place within 2 years from date of issuance of 2-year conditional green card.

Requirements for investment through a Regional Center

1. Applicant is required to submit an investment project to be approved by USCIS.

2. The Regional Center must satisfy all the conditions and be approved by USCIS.

3. Requirements for job creation programs more generous basic programs are always due to the indirect employment projects that generate.

1. Investment in a new business entity

- Total investment capital: US$1,000,000.

- Direct employment creates 10 official full-time jobs.

- Investors must be directly involved in the company management.

2. Investment through a Regional Center

- Total investment capital: US$500,000.

- Directly or indirectly creates 10 full time job opportunities.

- Investors are not required to create a new business.

- Investors are not required to directly participate in the management of the company.

Benefits of EB-5 investors: investors

- are granted green cards for whole family

- can go back to Vietnam several times each year, unlimited entry

- are not limited by age

- are not required for knowledge, learning foreign languages

- are not required to participate in the management of daily business

- are entitled to sponsor their relatives for the purpose of immigrating to the United States.

Legitimate sources of fund for EB-5 investment

The EB-5 investment (USD500,000 or USD1,000,000) may be originated from, including but not limited to:
- Profit of business after tax
- Personal income: salary, donation, inheritance, etc.
- Sale of real estate, stocks, shares, etc.
- And any other lawful means.
